PUBLIC HEARING – 7:30 PM

*a.     Sullivan, Mary S. (Sullivan Farm, LLC); property located of Towner Swamp Road.  Map 77, Lot 2,
        Zone R-8.  Amendment to the Zoning Code – Change of Zone:  Change current R-8 zone to
        MU/C1 zone.   Received 8/16 and again 9/6 to correct address and Map & Lot.  Opened and heard 10/4
        and continued to 11/1.
        
*b.     Mott, Dianne; property located at 2960 Boston Post Road.  Map 83, Lot 56, Zone R-7.   
        Amendment to the Zoning Code – Change of Zone:  Change current R-7 zone to MU/C1 zone.   
        Received 9/6.  Opened 10/4 and immediately tabled to 11/1.  Request of applicant to TABLE to 11/15.

1.      Barnes, Linda & Richard; property located at 16 Beach Road, Leetes’ Island.  Map 13, Lot 22, Zone
RS-1.  Coastal Area Management:  Very minor revision to include as-built deck.  Original application
        was approved (5/5/04) at public hearing because it was within 100 ft. of coastal resources.  §273-91.

2.      Gerhardy, Nancy B., property located at 262 Stone House Lane.  Map 34, Lot 32-10, Zone R-3.  Special
        Permit:  Apartment accessory to a single-family dwelling.  §273-19.  Received 9/20.   Request of
        applicant to TABLE to 11/15.

*3.     Amendment to Zoning Code re; “Affordable Housing”: Amend §273-2.  Word usage; definitions.
        “B”:   – creates definition of Affordable Housing consistent with State of Connecticut and Federal
        requirements.  Received 9/20.  Table to 11/15.

*4      Amendment to the Zoning Code §273-218 Option B; Density Multiplier Approach -  Revises
        multiplier which calculates the maximum number of lots which may be allowed in an Open Space
        Subdivision and creates incentive provisions to allow additional lots when proposed open space
        subdivisions contain affordable housing units, small houses and/or green houses as defined by the
        US Green Building Council.   Received 9/20.

*5      Amendment to the Subdivision Code §272-41 “Parks, recreation areas, open spaces and Town
        land”,  “Dedication of Land”, second bullet point, by revising the open space proportionality
        requirement to make proportionality a mandatory provision in providing open space for new
        subdivisions unless waived by the Commission.  Proportionality means that dedicated open space
        shall not consist of a greater percentage of area classified as wetland or steep slopes than the
        subdivision as a whole.    Received  9/20.

1.      Waldo, Russell W. (203-453-4386); property located off East Bear House Hill Road (Owner: Harriet V. Zipp
        Bypass Trust).  Map 93, Lot 2, Zone R-8.  Conventional Subdivision: 10 lots on 49.98 acres (open
        space: 7.23 acres, 14.5%).  Request waiver of driveway standards to allow 3 lots on one driveway.  
        IWC will receive 11/8.  Receive and set public hearing date (2/7/07).    

C.      Municipal Coastal Site Plan (CAM) - §273-91.
1.      Rea Algonquin Industries Division; property located at 129 Soundview Road.  Map 41, Lot 1, Zone I-2.  
        Municipal Coastal Site Plan Review: Construction of 12’ x 12’ x 8” concrete pad for air evaporator
        located next to the nitrogen tank more than 25 ft. from tidal wetlands.   Received 10/18.


D.      Special Permits - §273-99 & Article X.
1.      Felhandler/Steeneken Architects; property located at 101 West Lane (Owner: Kaplan).  Map 5, Lot 31, Zone
        R-6.  Special Permit and Municipal Coastal Site Plan:  Accessory apartment in accessory structure
        greater than 750 SF more than 100 ft. from coastal resources.  Receive and set public hearing date
        (12/6).

2.      Deveau, Paula & Tarutis, John (Will Thompson, AIA: 203-453-8761); property located at 58 High St.  Map
        33, Lot 66, Zone R-1.  Special Permit:  Apartment accessory in accessory structure over 10 years old.   
        §273-19.  Receive and set public hearing date (12/6).


E.      Old/New Business
1.      Request by citizens to begin Municipal Fine proceedings against MacLellan Guilford, LLC (Arrow
        Paving), 405 Whitfield St., for violations of outdoor storage and filling without site plan approval.  19 letters
        received.  Discussed at 10/18 meeting.  Applicant will be before the DRC 11/8.  Leave item on agenda to
        continue to monitor progress of applicant toward submitting applications.


F.      Correspondence                                          
1.      Guilford Food Center; property located at 77 Whitfield St.  Map 39, Lot 91, Zone C-1.  Request (10/24) to
        have a 48’ refrigerated trailer to be placed in the rear parking lot for the holiday season (11/16 – 12/26).

2.      Request (10/30) of Eric Anderson for 2nd 90-day extension to file mylars for “Wrede Property”, 114 Leetes
        Island Road, Map 21, Lot 26A, Zone R-5.  The subdivision was approved 5/17/06.  Final extension will expire
        on 2/17/07.
