*6.  Proposed Amendment to Chapter 273, Zoning Code, Regarding Open Space Subdivisions

Create a new “Article XXVII Open Space Subdivisions to allow Open Space Subdivisions by Special Permit in Residential Zones.  Open Space Subdivisions are a  more flexible method for the development of land which preserve substantial areas of open space and protect important natural and historic resources.   Open Space Subdivisions are permitted in R-5, R-6, R-7, and R-8 Zones.  In Open Space Subdivisions, area and bulk standards are relaxed in exchange for the granting of more open space.

*7.  Proposed Amendments to Chapter 272 Subdivision of Land, Regarding Open Space

Delete 272-21 “Open Space Subdivisions”

Delete 272-41 and Replace with a new 272-41 “Parks recreation areas, open spaces and Town land”.  The new section has the following important changes;
·       Increases the required open space dedication to 15%.
·       Requires that the open space dedicated be proportionate to the property as a whole with respect to wetlands, and steep slopes.
·       Establishes a Fee in Lieu of Land provision as an alternative to the dedication of open space land.

1.      D.A.D. Brecciaroli LTD Partnership (Russell Waldo & Associates: 203-453-4386); property located at 301
Soundview Road.  Map 42, Lots 118-2 & 118-3, Zone I-2.  Coastal Area Management and Revision to
Site Plan: Addition of 10 parking spaces more than 100 ft. away from coastal resources.  Site is
within 100-year flood hazard area Zone A.   Pending Inland Wetlands 10/12.  Received 9/7.

2.      Hickey, Dennis & Joan (Philippe Campus: 203-483-0468); property located at 43-45-47 Marshall Ave.  Map
10, Lot 105 & 106, Zone R-2.  Coastal Area Management Site Plan: Removal of 3 existing cottages on
Parcel “A” and construction of a new single-family dwelling within 100 ft. of coastal resources.
